Device Rental & Usage Terms

1. Applicability

All provisions of Device Rental & Usage Terms apply only to Himalayan Guardian Nepal Pvt. Ltd. products or services that include devices.

2. Device Model

The standard device is Tracer M3, unless another device is stated in the order confirmation or product documents.

3. Ownership and Right to Use

The ownership of the device(s) shall remain with Himalayan Guardian Nepal Pvt. Ltd., and the device holder shall only have the right to use the device(s) during the valid service period.

4. Device Deposit

A device security deposit of USD 150 should be required prior to device handover, unless otherwise agreed in writing with the customer.

5. Device Collection

The device holder may obtain the device either from their service-providing travel company or from our sales center. When obtaining the Device, the device holder shall be obligated to inspect the integrity of the Device’s appearance and functions.

6. The device holder Responsibilities

• Keep the device safe and under their control.
• Keep the device charged.
• Keep the device unobstructed and positioned with the antenna facing open sky during use.
• Avoid placing the device inside bags, pockets, rooms, vehicles, or covered areas during active travel.
• Use the SOS button only in genuine emergencies.
• Avoid unauthorized disassembly or tampering.
• Protect the device from damage, extreme conditions, misuse or any other malfunction.
• After the Device Activation Period ends, the device holder shall turn off the device as soon as possible and return the rented device to Himalayan Guardian Nepal Pvt. Ltd. .

7. SOS Misuse

The SOS function shall be used only in genuine emergencies. Any false, malicious, accidental, negligent, or unauthorized activation of the SOS function may trigger rescue, insurance, medical, and operational response procedures. The user shall be liable for any costs, expenses, penalties, losses, damages, or liabilities arising from such malicious use, misuse, or unauthorized activation.

8. Device Performance Limitations

Device performance and communication capabilities may be affected by, including but not limited to, the following factors:

• Signal obstruction;
• Enclosed or indoor environments;
• Mountain valleys, canyons, or terrain shielding;
• Urban buildings and other structural interference;
• Adverse weather conditions;
• Low battery level;
• Satellite, network, or telecommunications service disruptions;
• Incorrect device positioning or orientation;
• Extreme temperatures;
• Failure by the user to follow device instructions or operating guidelines.

Himalayan Guardian Nepal Pvt. Ltd. will use reasonable efforts to support the proper operation of the device; however, Himalayan Guardian Nepal Pvt. Ltd. does not warrant or guarantee uninterrupted, continuous, timely, or error-free device communication, positioning, tracking, or emergency signal transmission under all conditions.

9. Return of Device

The device holder must return the device after the service period ends. If the device is returned in proper working condition with all accessories, the security deposit will be refunded after inspection.

If the device is lost, damaged, malfunctioning due to personal reasons, or returned with missing accessories, Himalayan Guardian Nepal Pvt. Ltd. may deduct the applicable amount as per the Device Instructions. If the device is not returned within three (3) days after coverage expiration, Himalayan Guardian Nepal Pvt. Ltd. may treat it as lost while still retaining the right to request its return.
